The Pesticide Code of
Quebec was adopted and released by the Minister of Environment on
March 5, 2003 around 4:30 PM.
The following are the main features of the Code which cover the entire
Province of Quebec:
- It is now prohibited to apply pesticides that are most toxic
to health on the green spaces of public, semi-public, municipal lands,
hospitals and social and health services, Colleges (public and
private), Universities, areas of sports, leisure, cultural and artistic
activities where children are below 14 years.
- This prohibition will extend to private and commercial
properties in three years.
- For the herbicides which contain the active ingredients
2,4-D, MCPA and Mecoprop - the prohibition of these active ingredients
is based on the Precautionary Principle since doubts persist regarding
their toxicity. Results of re-evaluations by recognized authorities are
awaited.
- With immediate effect it is prohibited to use pesticides
(except for list in Annexe II) inside or outside all day care centers,
home daycare, pre-school, Primary and Secondary schools. There are
rules regarding the application of low impact or bio pesticides.
- During the preparation and application of pesticides, proper
distances (details mentioned in the Code) from water sources must be
maintained.
- While spraying for orchards or for traffic vehicle, train and
energy corridors, proper distances from human activity must be
maintained (details in the Code).
- Green space companies are not allowed to mix fertilizers with
pesticides.
- Three years from the adoption of the Code it is obligatory
for golf courses to deposit with the Ministry of Environment, a
triennial plan for the reduction of pesticides.
- Mixtures of insecticides and herbicides or fertilizers and
herbicides will not be allowed to be sold one year after the adoption
of the Code.
- In two years, it will be prohibited to directly sell to the
public, domestic products which are the most toxic (list attached Annex
I . These products must be held in a closed display arrangement.
Customers must be served by a person who can provide advice and
instructions on proper and safe handling of the product.
- Within three years, the sale of certain pesticides for
domestic green spaces treatment will be prohibited in Quebec.
- Some modifications have also been made to the 'Rules on
permits and certificates for the sale and utilisation of pesticides'.
This deals with and encompasses all the permits and certificates
specific to the sale and certification of all agricultural and forestry
producers who use pesticides.
- The Ministry of Environment will follow up plans to improve
the training of sales people who work in the sales and use of
pesticides.
- To better protect the underground water supply, modifications
to the 'Regulations regarding pumping underground waters' are in
preparation.

Octaborate disodique Tetrahydrate,Phosphate Ferrique, Insecticidal
soap, Spinosad, Sulphur, Sulfur of Calcium or Polysulfur of Calcium,
Acetic acid, Melange d'acides caprique et pelargonique, Herbicide soap
